QUESTIONS AND ANSWERS REGARDING THE OFFER TO SETTLE POTENTIAL CLAIMS FROM SYUFY ENTERPRISES
Lawsuits are time-consuming, expensive, and the outcome is never guaranteed. While Syufy Enterprises believes the class action lawsuit filed by PLAINTIFF will be dismissed, one can never be certain about the outcome of litigation. Syufy Enterprises has made a business decision to offer direct settlements with individuals to settle these California wage and hour claims: (1) Failure to Pay Minimum Wages; (2) Unpaid Overtime; (3) Meal Break Violations; (4) Rest Break Violations; (5) Wages Not Timely Paid During Employment; (6) Wage Statement Violations; (7) Untimely Final Wages; (8) Failure to Reimburse Necessary Business Expenses; and (9) Unfair Competition.
PLAINTIFF seeks unpaid wages, statutory penalties, and attorney fees and costs under the California Labor Code, applicable California Industrial Welfare Commission Wage Orders, and the California Business and Professions Code. If you reject the settlement offer, it is possible you could receive more from the class action filed by PLAINTIFF than what Syufy Enterprises is offering now. But it is also possible Syufy Enterprises will prevail and you will receive nothing. It is also possible that Syufy Enterprises might settle the class action claims with PLAINTIFF. If you reject the current offer, you might receive less through a potential settlement than what Syufy Enterprises is offering you now.
You do not need to agree with PLAINTIFF’s allegations in order to accept this settlement offer.

Nothing. You will not be subject to retaliation or any other negative consequence for not accepting the offer. Although Syufy Enterprises believes the offer is fair and hopes you will accept it, your decision will be respected either way.

Your Settlement Payment will be initiated within 7 days of receiving your signed Settlement Agreement and Release Form.
